1. Introduction

AptInquiry is a trade name (d/b/a) of JLU Consultants LLC, a New York limited liability company ("Company," "we," "us," or "our"). References to "AptInquiry" throughout this Policy refer to JLU Consultants LLC operating as AptInquiry. Our operations are conducted in New York City, New York.

We provide an AI-powered leasing platform for New York City landlords, property managers, and real estate brokers. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our website, web application, and related services (collectively, the "Service"). By using the Service, you agree to the practices described in this Policy.

This Policy is governed by applicable federal law and New York State law, including the New York SHIELD Act (Stop Hacks and Improve Electronic Data Security Act), N.Y. Gen. Bus. Law § 899-aa et seq.

2. Information We Collect

2.1 Information You Provide

  • Account information: Name, company name, phone number, and email address when you register.
  • Listing information: Property address, unit number, rent amount, apartment details, and any custom context you provide for AI responses.
  • Payment information: Billing details are collected directly by our payment processor (Stripe, Inc.) and are not stored on our servers. We receive only a tokenized reference.
  • Communications: Email and SMS messages sent to the address and phone number assigned to your account, including inquiries from prospective tenants and your replies.

2.2 Information Collected Automatically

  • Log data: IP address, browser type, pages visited, time and date of visits, and referring URLs.
  • Device information: Operating system, device identifiers, and browser settings.
  • Cookies and similar technologies: Session cookies used for authentication. We do not use third-party advertising trackers.

2.3 Information from Third Parties

  • Inbound email: Email content routed to the address assigned to your account through our email delivery provider.
  • Inbound SMS: Text message content routed through Twilio, Inc. to the phone number assigned to your account.
  • Phone verification: One-time passcodes delivered via Twilio, Inc. for account authentication.

3. How We Use Your Information

We use collected information to:

  • Create and manage your account and process authentication.
  • Operate the AI leasing service, including generating and routing automated email and SMS replies on your behalf.
  • Extract and display applicant information (e.g., move-in date, income, pets) within your dashboard.
  • Detect and filter spam and scam inquiries.
  • Process subscription payments and manage billing.
  • Send transactional communications (e.g., OTP codes, escalation alerts, account notifications) by email and SMS.
  • Improve our services, train and evaluate AI models on aggregated or anonymized data, and conduct internal analytics.
  • Comply with legal obligations and enforce our Terms of Service.

We do not sell your personal information to third parties. We do not use your personal information for targeted advertising.

4. SMS/Text Messaging

This section describes our text messaging practices and applies to all SMS sent or received through the Service. For a plain-language summary of how to opt in and opt out, see our SMS Policy.

Consent and opt-in. We send SMS only to individuals who have consented to receive them:

  • Account holders (landlords, property managers, brokers): By providing your mobile phone number during account registration and completing phone verification, you consent to receive authentication messages (one-time passcodes). Optional SMS notifications — such as escalation alerts and account notifications — are sent only if you separately opt in during registration or in your account settings. Consent to optional SMS notifications is not a condition of purchasing or using the Service. Account holders may also receive operational SMS tied directly to their own account (tour alerts, billing notices, a teammate invitation) that is not gated behind that optional opt-in.
  • Prospective tenants (applicants): Every account has one phone number covering all of that landlord's or broker's listings. If you text that number to inquire about a rental, you initiate the conversation and consent to receive conversational replies about the listing you're asking about. We never send the first message to an applicant.

Message frequency varies depending on your account activity and applicant conversation volume.

Message and data rates may apply. Standard carrier charges may apply to messages you send and receive.

Opt-out. You may opt out of SMS at any time by replying STOP to any message. You will receive a final confirmation message, after which no further messages will be sent to your number (other than any legally required confirmations). Account holders may also disable optional SMS notifications in account settings. Opting out of optional notifications does not affect authentication messages required to access your account while it remains active.

No third-party sharing of mobile information. Mobile phone numbers, SMS consent, and text messaging originator opt-in data will not be shared with, sold to, or transferred to third parties or affiliates for marketing or promotional purposes. Mobile information is shared only with service providers acting on our behalf as necessary to deliver messages (see Section 5), and this sharing excludes any use for their own marketing.

5. Disclosure of Information

We may share your information with:

  • Service providers: Anthropic, PBC (AI processing); our email delivery provider (email routing and delivery); Twilio, Inc. (SMS and phone OTP); Stripe, Inc. (payment processing). These providers process data only as necessary to perform services on our behalf and may not use it for their own purposes, including marketing.
  • Law enforcement and legal process: When required by applicable law, court order, or governmental authority, including New York State and federal agencies.
  • Business transfers: In connection with a merger, acquisition, or sale of assets, subject to confidentiality obligations.
  • With your consent: For any other purpose with your explicit consent.

For clarity, and consistent with Section 4: mobile phone numbers and SMS opt-in data are never shared with third parties or affiliates for their marketing purposes.

6. Data Security

We implement reasonable technical and organizational measures to protect personal information from unauthorized access, disclosure, alteration, or destruction, consistent with the requirements of the New York SHIELD Act. These measures include encryption of data in transit (TLS), encrypted storage of sensitive fields, access controls, and regular security reviews.

In the event of a breach of private information affecting New York residents, we will notify affected individuals and applicable authorities as required by N.Y. Gen. Bus. Law § 899-aa and other applicable notification laws.

7. Tenant Applicant Data

Our Service processes email and SMS inquiries from prospective tenants on behalf of landlords and brokers. If you are a prospective tenant whose inquiry was routed through our platform, your message content and extracted information (e.g., income, pets, move-in date) are stored and made available to the landlord or broker. You may request deletion of your data by contacting us at legal@aptinquiry.com. We will forward such requests to the applicable account holder.

8. Data Retention

We retain account information and listing data for the duration of your subscription plus 90 days following termination, after which it is deleted or anonymized. Conversation and message data is retained for up to 3 years unless you request earlier deletion. Records of SMS consent and opt-out are retained as required for compliance purposes. Audit logs are retained as required by applicable law. Anonymized or aggregated data may be retained indefinitely.

9. Your Rights and Choices

You have the right to:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Update inaccurate or incomplete information via your account settings or by contacting us.
  • Deletion: Request deletion of your personal information, subject to our legal obligations and legitimate business needs.
  • Portability: Request your data in a portable format where technically feasible.
  • Opt out of SMS: Reply STOP to any text message, or disable optional SMS notifications in account settings (see Section 4).
  • Opt out of non-essential communications: Unsubscribe from marketing emails at any time. Transactional messages (e.g., billing alerts, security notifications) are required for operation of the Service.

10. Children's Privacy

The Service is intended solely for business use by adults who are property owners, managers, or licensed real estate professionals. We do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected such information, we will delete it promptly.

11. Electronic Communications

Email communications sent through the Service on your behalf are governed by the CAN-SPAM Act (15 U.S.C. § 7701 et seq.) and applicable New York law. Outbound emails include a physical mailing address and, where applicable, instructions for recipients to opt out of future communications. Text messaging is conducted in accordance with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and Section 4 of this Policy.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or a prominent notice within the Service at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Policy.
